By placing your finger on the sensor during the sign up process, and using the Pay By Touch™ service ("Service") to pay for goods or services or to cash checks, you are notifying us that you have read, understand and agree to abide by these terms and conditions. You agree to authorize Pay By Touch merchants ("Merchants") and Pay By Touch, its affiliates and its subsidiaries to electronically debit or credit each account enrolled, to verify your identity in order to cash a check, or deliver your age-verification, membership and loyalty information to Merchants. The authorization to complete such transactions will remain in effect until you terminate your Pay By Touch wallet.

In signing up for and using the Service, you agree to comply with all applicable U.S. laws and regulations. You agree that Pay By Touch has the discretion to suspend or terminate your account and refuse any current or future use of the Service (or any portion thereof). Pay By Touch reserves any rights not expressly granted herein.

If you have signed up for eCheck, you represent and warrant that you have authority to make withdrawals from and otherwise bind your checking account. In the event that your bank does not allow electronic transactions, you authorize Pay By Touch to convert the electronic transaction data to a paper draft for presentment to your bank. In the event that your bank denies the electronic transaction and returns the electronic payment to Pay By Touch, you authorize Pay By Touch to re-present the original electronic transaction amount and initiate a new transaction, and authorize Pay By Touch, its agent or its participating Merchant to debit your account electronically for a processing fee up to $20 or the maximum amount allowed by applicable state law.

If you have signed up for Check Cashing, you represent and warrant that you have authority to cash the checks that you present to a Merchant. It is the participating Merchant who collects any check-cashing fees, and Pay By Touch does not assume any responsibility or accountability for such fees.

THE PAY BY TOUCH SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OR REPRESENTATIONS WHATEVER OF ANY KIND, WHETHER EXPRESS OR IMPLIED. Pay By Touch will not be liable or responsible for any damage or injury caused by your use of the Service.

You agree that this Agreement will be governed and interpreted under the laws of the State of California and that any disputes hereunder shall be subject to the jurisdiction of the state and federal courts located in San Francisco.

Your submission of data through enrollment is governed by Pay By Touch's privacy policy located at www.paybytouch.com/privacypolicy.
